PLEASE READ THIS DOCUMENT CAREFULLY BEFORE PARTICIPATING IN ANY EVENT OR ACTIVITY DISCOVERED THROUGH TERENGO. BY PARTICIPATING, YOU AGREE TO THE TERMS BELOW.
This Assumption of Risk & Release of Liability ("Agreement") is entered into between you ("Participant," "you," or "your") and TerenGO LLC, a Colorado limited liability company ("TerenGO," "we," "our," or "us"), and the event organizer who created the event you are joining.
1. General Assumption of Risk
You acknowledge and understand that:
Outdoor recreational activities involve inherent risks including but not limited to: physical injury, illness, death, property damage, falls, collisions, exposure to weather, wildlife encounters, equipment failure, getting lost, drowning, avalanche, rockfall, and other hazards.
Activities arranged through TerenGO involve meeting other users who are strangers. TerenGO does not screen, vet, verify, or conduct background checks on any user or event organizer.
You voluntarily assume all risks associated with participating in any event discovered through TerenGO.
You are solely responsible for evaluating the safety and suitability of any event, location, route, weather condition, and the event organizer before participating.
2. Sport-Specific Risks
Without limiting the generality of the above, you acknowledge the following risks specific to each activity type:
Hiking
Terrain hazards including uneven ground, loose rocks, steep drop-offs, and slippery surfaces
Altitude sickness, dehydration, and heat-related illness
Wildlife encounters including bears, mountain lions, snakes, and insects
Severe weather exposure including lightning, hypothermia, and heat stroke
Getting lost or disoriented, especially in remote or unmarked areas
Road Cycling
Vehicle collisions with cars, trucks, and other motorists
Road hazards including potholes, debris, railroad tracks, and gravel
Mechanical failure including tire blowouts, chain breaks, and brake failure
High-speed crashes resulting in serious injury or death
Gravel Riding
Loose surface conditions including gravel, sand, mud, and washboard roads
Remote locations with limited or no cell service
Limited access to emergency medical services
Mountain Biking
Trail obstacles including rocks, roots, logs, and drop-offs
Falls at speed on technical terrain
Terrain hazards including cliff edges, water crossings, and loose surfaces
Equipment failure including suspension, brake, and tire failure
Climbing
WARNING: Climbing involves the risk of serious injury or death regardless of safety equipment used.
Fall risk from height, including ground falls and leader falls
Anchor failure, bolt failure, and protection pulling out
Equipment failure including rope, harness, carabiner, and belay device failure
Rockfall from natural causes or other climbers
Belaying errors by partners, including dropped climbers
Skiing
Avalanche risk in backcountry and sidecountry terrain
Terrain hazards including trees, rocks, cliffs, and variable snow conditions
Collisions with objects, other skiers, or snowboarders
Lift accidents including loading, unloading, and chairlift mechanical failure
Rapidly changing weather and visibility conditions
Backcountry terrain involves remoteness and significant rescue difficulty
Snowboarding
All risks associated with skiing as described above
Additional impact risks from jumps, terrain features, and halfpipe riding
Wrist, shoulder, and head injuries from falls unique to snowboarding stance
Trail Running
Uneven terrain including rocks, roots, and loose surfaces causing falls
Remote locations with limited access to emergency services
Weather exposure including lightning, extreme heat, and hypothermia
Wildlife encounters
Road Running
Vehicle traffic and collisions with motorists
Heat exhaustion, heat stroke, and hyponatremia
Dehydration and cardiovascular events
Fishing
Water hazards including drowning, swift currents, and cold water immersion
Slippery conditions on rocks, riverbanks, and boat surfaces
Hook injuries from casting and handling fish
Wildlife encounters including bears and snakes near waterways
Weather exposure including lightning near water
Pickleball
Repetitive motion injuries including tennis elbow and shoulder strain
Falls on court surfaces
Paddle injuries from contact with other players
Heat exposure during outdoor play
Tennis
Repetitive motion injuries including tennis elbow, rotator cuff strain, and wrist injuries
Ankle sprains and knee injuries from sudden direction changes and lateral movement
Eye injuries from ball impact, particularly during volleys and at the net
Slips and falls on court surfaces, including clay courts during wet conditions
Heat exhaustion, dehydration, and sun exposure during outdoor matches
Back and shoulder strain from serving motion
Collisions with the net post, fencing, or other players during doubles play
Table Tennis
Repetitive motion injuries including elbow strain, wrist strain, and shoulder strain
Eye injuries from ball impact, particularly during fast-paced exchanges
Slips and falls on smooth or polished court surfaces
Strains and sprains from sudden lateral movements
Collisions with table edges, walls, or other players in small venues
Walking
Falls on uneven terrain, curbs, stairs, ice, or wet surfaces
Vehicle traffic and collisions with motorists when walking on or near roads
Weather exposure including heat exhaustion, hypothermia, sunburn, and lightning
Dehydration and fatigue on long-distance walks
Wildlife encounters in nature and trail settings
Personal safety risks when walking in unfamiliar or isolated areas
Stand-Up Paddleboarding (SUP)
WARNING: Water sports involve the risk of drowning, even in shallow water and even when wearing a personal flotation device.
Drowning, including in flat water, surf, and whitewater conditions
Cold water immersion leading to shock, hypothermia, and impaired swimming ability
Being blown offshore by wind, especially on lakes, reservoirs, and open water
Strong currents, riptides, tidal changes, and unpredictable water conditions
Board strike injuries to the head, face, and body from your own board or other paddlers' boards
Marine and aquatic wildlife encounters including snakes, alligators, and stinging organisms
Lightning strikes on or near water
Whitewater-specific risks including entrapment, foot pinning, strainers, and hydraulic features
Loss of paddle or board leash failure leaving you separated from your equipment
Surfing
WARNING: Surfing involves the risk of serious injury or death, including drowning, head and spine injury, and catastrophic injury in large surf.
Drowning, even in shallow water and even when wearing a surfboard leash or personal flotation device
Multi-wave hold-downs and underwater disorientation about which direction is the surface
Cold water immersion leading to shock, hypothermia, and impaired swimming ability within minutes
Strikes from your own surfboard during wipeouts and wave impacts, including head, face, and concussion injuries
Strikes from other surfers' boards in shared lineups, drop-ins, and crowded conditions
Lacerations and puncture wounds from surfboard fins, foils, and rails
Wave-driven impact with the bottom — sand, rocks, coral reef, urchin beds, or other surfaces — causing lacerations, abrasions, broken bones, and spinal injury
Reef and rock break hazards including coral cuts, urchin spines, and rock impact
Catastrophic injury or death in large-wave and tow-in disciplines, with limited rescue windows in heavy surf
Jet ski operations associated with tow-in surfing or rescue activity, including impact, propeller, and exhaust risks
Marine and aquatic wildlife encounters including sharks, stinging organisms, jellyfish, stingrays, and other animals
Equipment failure including board damage, leash failure, fin loss, wetsuit malfunction, and impact-vest malfunction leaving you separated from your equipment in compromised conditions
Strong currents, riptides, and rapidly changing wave conditions carrying you away from your intended location
Lightning strikes on or near open water and any nearby high ground
Golf
Lightning strikes on exposed fairways and open course terrain
Impact injuries from errant golf balls, including serious eye injuries, head injuries, and broken bones from balls traveling at high speed
My responsibility as a player to warn others by shouting "Fore!" whenever a ball is heading toward another person, and my potential liability for failing to do so
Golf cart accidents including rollovers, ejections, and collisions, particularly on slopes, wet paths, and cart paths near water hazards
Cart operation risks including driving under the influence, exceeding passenger capacity, riders standing or hanging off the cart, and failure to follow course rules and posted age restrictions
Property damage liability from errant balls hitting vehicles, houses, windows, or other property in or near the course
Heat exhaustion, dehydration, and sun exposure during long rounds
Slips and falls on wet greens, sand traps, cart paths, and steep terrain
Repetitive motion injuries including back strain, shoulder injury, and elbow tendonitis
Encounters with wildlife near water hazards and wooded course areas
3. Release of Liability
READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.
You hereby release, discharge, and hold harmless the event organizer, TerenGO LLC, and their respective officers, directors, employees, volunteers, agents, and representatives (collectively, the "Released Parties") from any and all claims, demands, damages, losses, costs, expenses, causes of action, or liabilities of any kind, whether known or unknown, arising from or related to your participation in any event, activity, or meetup discovered or arranged through TerenGO, including but not limited to claims caused by the negligence of the Released Parties.
This release covers both known and unknown risks. You expressly waive any rights you may have under any statute or common law principle that would otherwise limit the coverage of this release to include only those claims which you may now know or suspect to exist in your favor at the time of agreeing to this release.
4. Indemnification
You agree to indemnify, defend, and hold harmless the Released Parties from and against any and all claims, demands, damages, losses, costs, expenses (including reasonable attorneys' fees), and liabilities brought by any third party arising from or related to your conduct, actions, or omissions during any event, activity, or meetup discovered or arranged through TerenGO.
5. Medical Fitness
You certify that you are in good physical condition and have no medical conditions, disabilities, or ailments that would prevent you from safely participating in the activity or event.
You authorize emergency medical treatment in the event that you are incapacitated or unable to provide consent during or after an activity.
You agree to bear all costs associated with any emergency medical treatment, rescue, evacuation, or hospitalization that may be required as a result of your participation.
6. Photo and Media Release
You grant permission to the event organizer and TerenGO LLC to use, reproduce, distribute, and display any photographs, video, or other media taken during events in which you participate, for promotional, marketing, editorial, or any other lawful purpose, without compensation, notification, or further approval.
7. Electronic Signature
Your typed name on the in-app waiver constitutes a legally binding electronic signature under the Electronic Signatures in Global and National Commerce Act (E-SIGN Act), 15 U.S.C. § 7001 et seq.
By typing your name and tapping "I Agree," you confirm that:
You have read and understood this entire Agreement
You voluntarily agree to all of its terms
You intend your electronic signature to have the same legal force as a handwritten signature
Your acceptance is timestamped and stored permanently in TerenGO's systems. Signed waivers cannot be revoked after the event has taken place.
8. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the State of Colorado, United States, without regard to its conflict of law provisions.
Any dispute, claim, or controversy arising out of or relating to this Agreement shall be resolved by binding arbitration administered by the American Arbitration Association ("AAA") in Denver, Colorado. You waive any right to a jury trial or to participate in a class action.
