Welcome to TerenGO. These Terms of Use ("Terms") constitute a legally binding agreement between you ("you," "your," or "User") and TerenGO LLC, a Colorado limited liability company located at 1500 N Grant St Ste N, Denver, CO 80203, US ("TerenGO," "we," "our," or "us").
By creating an account, accessing, or using the TerenGO mobile application (the "App") or any related services (collectively, the "Service"), you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.
You must be at least 18 years of age to create an account or use the Service. By using TerenGO, you represent and warrant that you are at least 18 years old. If we discover that a user is under 18, we will immediately terminate their account.
You must be a natural person. Accounts operated by bots, scripts, or automated means are prohibited and will be terminated.
TerenGO is a mobile application that helps connect outdoor enthusiasts by sport, skill level, and location. The Service enables users to:
Event organizers may create organizer accounts to post events, communicate with attendees, and access an organizer dashboard.
To use the Service, you must create an account by providing accurate, current, and complete information including your name, email address, username, and password. You agree to update your information promptly if it changes.
You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must immediately notify us at hello@terengo.com if you suspect unauthorized access to your account.
Each person may maintain only one personal account. Creating multiple accounts, sharing accounts, or transferring accounts is prohibited.
You agree not to use the Service to:
We reserve the right to investigate and take appropriate action against anyone who violates this section, including removing content, issuing warnings, suspending accounts, or permanently banning users.
You retain ownership of any content you post, upload, or share through the Service ("User Content"), including profile information, activity descriptions, photos, messages, ratings, and reviews.
By posting User Content, you grant TerenGO a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, modify, display, distribute, and create derivative works of your User Content in connection with operating and providing the Service. This license ends when you delete your User Content or your account, except where your content has been shared with others who have not deleted it, or where retention is necessary for legal purposes.
We reserve the right, but have no obligation, to review, monitor, edit, or remove any User Content at our sole discretion. Content that violates these Terms, our community guidelines, or applicable law may be removed without notice. Repeated violations will result in account suspension or termination.
You are solely responsible for your User Content. You represent that you have the right to post it and that it does not violate any third party's rights.
TerenGO offers optional safety features including:
These safety features are provided as-is and are not substitutes for personal judgment, common sense, or professional safety measures. TerenGO does not verify the identity, background, or intentions of any user. We do not conduct background checks. You participate in all activities at your own risk.
The Service may display weather forecasts, road conditions, and avalanche risk information sourced from third parties. This information is provided for convenience only and may be inaccurate, incomplete, or outdated. Always check official sources and use your own judgment before participating in outdoor activities.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
TERENGO, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, DATA, BODILY INJURY, EMOTIONAL DISTRESS, DEATH, OR OTHER INTANGIBLE LOSSES, REGARDLESS OF WHETHER SUCH DAMAGES ARE BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, AND REGARDLESS OF WHETHER TERENGO HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT SHALL TERENGO'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE EXCEED THE AMOUNT YOU HAVE PAID TO TERENGO IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR FIFTY DOLLARS ($50.00), WHICHEVER IS GREATER.

You agree to indemnify, defend, and hold harmless TerenGO, its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:
TerenGO offers a free tier with limited features and a Pro subscription tier at $4.99 per month (or current pricing as displayed in the App). Pro features include expanded activity limits, increased discovery radius, map access, and other premium features as described in the App.
Subscriptions are billed through Apple's App Store or Google Play Store. By subscribing, you authorize recurring charges at the then-current subscription rate. All payments are processed by the respective app store and subject to their terms.
Subscriptions automatically renew at the end of each billing period unless canceled at least 24 hours before the renewal date. You can manage and cancel your subscription through your device's app store settings.
Refunds are handled by Apple or Google in accordance with their respective refund policies. TerenGO does not directly process payments or issue refunds. If you believe you were charged in error, contact the respective app store support.
We may change subscription pricing at any time. Price changes will not affect your current billing period but will apply upon renewal. We will provide notice of price changes in advance.
Users may create organizer accounts to post events. Event organizers are solely responsible for their events, including accuracy of event information, safety of participants, compliance with local laws and regulations, and obtaining any required permits or insurance.
Event organizers represent and warrant that:
TerenGO provides the platform for event organizers to post and promote events. TerenGO does not co-organize, endorse, sponsor, or assume any responsibility for any event. The relationship between event organizers and attendees is solely between those parties.
We may, in our sole discretion and without prior notice, suspend, restrict, or terminate your account and access to the Service for any reason, including but not limited to:
TerenGO may implement a warning and strike system for policy violations. Accumulation of strikes may result in temporary suspension or permanent ban. The specific thresholds and consequences are at TerenGO's sole discretion.
You may delete your account at any time through the App settings. Upon deletion, your profile, activities, and associated data will be removed in accordance with our Privacy Policy.
Upon termination, your right to use the Service ceases immediately. Sections 5.2 (License Grant), 7 (Assumption of Risk), 8 (Limitation of Liability), 9 (Indemnification), 14 (Governing Law), and 15 (Dispute Resolution) survive termination.
The Service, including but not limited to the App, website, software, code, design, graphics, logos, trademarks, trade names ("TerenGO"), and all related intellectual property, are owned by TerenGO LLC or its licensors. All rights not expressly granted are reserved.
You may not:
These Terms shall be governed by and construed in accordance with the laws of the State of Colorado, United States, without regard to its conflict of law provisions. Any legal action or proceeding relating to these Terms shall be brought exclusively in the state or federal courts located in Denver County, Colorado, and you consent to the personal jurisdiction of such courts.
Before filing any claim, you agree to attempt to resolve any dispute informally by contacting us at hello@terengo.com. We will attempt to resolve the dispute informally within 30 days.
If the dispute is not resolved informally, you and TerenGO agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved by binding individual arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules. The arbitration shall take place in Denver, Colorado, unless you and TerenGO agree otherwise.
YOU AND TERENGO AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS OR REPRESENTATIVE ACTION. Unless both you and TerenGO agree otherwise, the arbitrator may not consolidate or join more than one person's or party's claims.
Either party may bring claims in small claims court if eligible. Either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement of intellectual property rights.
The Service may integrate with or contain links to third-party services, including but not limited to:
TerenGO is not responsible for the content, policies, or practices of any third-party service. Your use of third-party services is at your own risk and subject to their respective terms and privacy policies.
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
TerenGO does not warrant that:
Your privacy is important to us. Our collection, use, and disclosure of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the practices described in our Privacy Policy.
We may update these Terms at any time. When we make material changes, we will:
Your continued use of the Service after the effective date of updated Terms constitutes your acceptance of the changes. If you do not agree to the updated Terms, you must stop using the Service and delete your account.
These Terms, together with the Privacy Policy, constitute the entire agreement between you and TerenGO regarding the Service and supersede all prior agreements.
If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.
TerenGO's failure to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision.
You may not assign or transfer these Terms or your rights under them without our written consent. TerenGO may assign these Terms without restriction.
Nothing in these Terms creates a partnership, joint venture, employment, or agency relationship between you and TerenGO.
